So about two days before the hurricane, a pack of candles at the small Key Food on Queens Boulevard was $4.99. Then, a day before the hurricane, the same pack of candles was $8.99. How can they get away with this obvious price gouging? (This is just one glaring example of it at this Key Food).

I'd like to file a formal complaint -- any ideas about where's the best place to do this? Would it be nyc.gov? And does anybody know the address of this Key Food? I'm trying to find it online but keep getting different addresses for different Key Foods in the area -- I want to make sure to complain about the right one (the small one across Queens Boulevard from the Midway theater). Thanks!

You can complain to the NYS Attorney General, as a state law is being violated. If you click onto the link for the first article in my earlier post, there is a link to the AG's site.

Thanks, all. I just sent my complaint to the NYS Attorney General. I bet they do nothing, as I've complained about this Key Food before and nothing's changed (most of their prices are wrong at the register and when you call them on it, they yell at you). Horrible place.

Not sure which key food you are referring to. There are 3 all on queens blvd.
Regardless, it's not price gauging if they took something "off sale". Meaning candles that were discounted before are now being sold at regular price.
At the end of the day, it's unfortunate but how do you prove something illegal took place?

The General Business Law does give some guidance, stockguru.
3. Whether a price is unconscionably excessive is a question of law
for the court.
(a) The court's determination that a violation of this section has
occurred shall be based on any of the following factors: (i) that the
amount of the excess in price is unconscionably extreme; or (ii) that
there was an exercise of unfair leverage or unconscionable means; or
(iii) a combination of both factors in subparagraphs (i) and (ii) of
this paragraph.
(b) In any proceeding commenced pursuant to subdivision four of this
section, prima facie proof that a violation of this section has occurred
shall include evidence that
(i) the amount charged represents a gross disparity between the price
of the goods or services which were the subject of the transaction and
their value measured by the price at which such consumer goods or
services were sold or offered for sale by the defendant in the usual
course of business immediately prior to the onset of the abnormal
disruption of the market or
(ii) the amount charged grossly exceeded the price at which the same
or similar goods or services were readily obtainable by other consumers
in the trade area.
